Terms of service.

1. Products and Services

Draft Protocol offers digital information products consisting of documentation, code, templates, and instructional materials related to AI-powered content systems. The following products are currently available:

• Content Blueprint ($497 one-time payment) — Documentation, templates, and methodology for implementing a quality-gated content workflow.
• Full Agentic System ($2,997 one-time payment) — Complete system including code, configuration files, deployment guides, and all Blueprint materials.

All products are digital downloads delivered electronically. No physical goods are shipped. Product specifications and pricing are subject to change without notice; however, any changes will not affect purchases already completed.

2. Purchase and Delivery

2.1. All payments are processed securely through Stripe, Inc. ("Stripe"). By making a purchase, you also agree to Stripe's Terms of Service.

2.2. Upon successful payment, you will receive an email containing a secure link to access and download your purchased materials. It is your responsibility to provide a valid email address at the time of purchase.

2.3. All prices are listed in United States Dollars (USD). You are responsible for any applicable taxes, duties, or fees imposed by your jurisdiction.

2.4. Each purchase is a one-time transaction. There are no recurring charges, subscriptions, or installment plans from Draft Protocol. Note that the Full Agentic System tier requires third-party services (such as Claude Code Pro and hosting providers) that carry their own independent costs.

3. License Grant

3.1. Upon purchase, we grant you a non-exclusive, non-transferable, perpetual license to use the purchased materials for your own personal and commercial purposes, subject to the restrictions in Section 4.

3.2. "Commercial use" means you may use the system to produce content for yourself, your business, or your clients. You may deploy the system for your own operations and modify the code and templates to suit your needs.

3.3. This license is granted to you as an individual. You may not transfer, assign, sublicense, or share your access credentials or downloaded materials with any third party.

4. Prohibited Uses

You expressly agree not to:

• Resell, redistribute, sublicense, or otherwise make the purchased materials available to any third party, whether for free or for compensation.
• Share, publish, or publicly post the source code, documentation, templates, or any substantial portion of the materials.
• Create derivative products intended for resale that are substantially based on the purchased materials (e.g., repackaging the system as your own product or course).
• Remove, alter, or obscure any proprietary notices, watermarks, or attribution contained in the materials.
• Use the materials for any purpose that violates applicable law or regulation.
• Misrepresent authorship or origin of the system or its components.

Violation of these restrictions constitutes a material breach of these Terms and may result in immediate termination of your license without refund, in addition to any other remedies available at law or in equity.

5. Intellectual Property

5.1. All materials, including but not limited to code, text, documentation, templates, designs, methodologies, and trade secrets contained in Draft Protocol products, are and remain the intellectual property of Ruslan Galba / Draft Protocol.

5.2. Your purchase grants a license to use the materials as described in Section 3. No ownership rights, copyrights, or intellectual property rights are transferred to you through this purchase.

5.3. Content you produce using the system is yours. We claim no ownership or rights over any output generated through your use of the purchased materials.

6. Refund Policy

Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference. We offer a 30-day implementation guarantee subject to the conditions described therein.

7. Disclaimer of Warranties

7.1. THE MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2. We do not warrant that the materials will meet your specific requirements, produce any particular results, or that any content generated using the system will achieve specific engagement metrics, follower counts, or revenue outcomes.

7.3. We do not warrant uninterrupted or error-free operation of any code included in the materials, nor do we guarantee compatibility with all third-party services, platforms, or environments.

8. Limitation of Liability

8.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DRAFT PROTOCOL, RUSLAN GALBA, OR ANY AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR PURCHASE OR USE OF THE MATERIALS.

8.2. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

9. Third-Party Services

9.1. Use of the Full Agentic System requires third-party services such as Claude Code Pro (approximately $100-200/month), hosting providers like Railway (approximately $5-20/month), and social media platform APIs. These services are provided by independent third parties and are subject to their own terms, pricing, and availability.

9.2. We are not responsible for changes in pricing, availability, terms, or functionality of any third-party service. Your relationship with those providers is governed solely by their respective agreements.

10. Age Requirement

You must be at least eighteen (18) years of age or the age of majority in your jurisdiction, whichever is greater, to purchase or use Draft Protocol products. By completing a purchase, you represent and warrant that you meet this age requirement.

11. Indemnification

You agree to indemnify, defend, and hold harmless Draft Protocol, Ruslan Galba, and any affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of the purchased materials; (b) content you produce using the system; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Florida, and the parties hereby consent to personal jurisdiction and venue therein.

13. Dispute Resolution

11.1. Before initiating any formal legal proceedings, you agree to first contact us directly to attempt to resolve the dispute informally. You may reach us by messaging @iamgalba on X.

11.2. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall be conducted in English and the arbitrator's decision shall be final and binding.

14. Force Majeure

Neither party shall be liable for any failure or delay in performance arising out of causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, government actions, war, terrorism, labor disputes, power failures, internet or telecommunications failures, or third-party service provider outages.

15. Waiver

The failure of Draft Protocol to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Draft Protocol.

16. Modifications to Terms

12.1. We reserve the right to modify these Terms at any time. The "Last updated" date at the top of this page will reflect the most recent revision.

12.2. Continued use of purchased materials after any modification constitutes acceptance of the updated Terms. Material changes will be communicated via the email address associated with your purchase, where practicable.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

18. Entire Agreement

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Draft Protocol with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
